URGENT: Know Your Rights

With the increased Immigration and Customs Enforcement (ICE) presence in our communities, it is vital that you know your rights. Oregon is a sanctuary state. That means Oregon’s law prohibits state and local government, including police, from helping enforce federal immigration laws without an order signed by a judge. However, federal immigration agencies like ICE can lawfully conduct business in our state, which means that ICE can investigate, detain, transport, and deport people from Oregon. It is critical to know your rights and be prepared to respond safely if you encounter ICE in the community.

The U.S. Constitution protects the rights of everyone in this country—regardless of immigration status or who is in the White House.

Here’s what to know if you have an encounter with an Immigration and Customs Enforcement (ICE) agent:

  • You have the right to remain silent.

  • Do not sign any documents without consulting an attorney.

  • Do not grant permission to enter your home.

  • You have the right to ask, “Am I free to go?”

  • If they arrest you, ask to speak with an attorney.

  • Do not show or use any fraudulent documents or documents with a false name on them.

  • Ask to see a warrant before opening the door if an immigration officer comes to your home or work. Look for a judicial warrant, meaning it is issued by a court and signed by a judge.
